News - Changes to CDM Regulations

The final draft of the new Construction (Design & Management) Regulations is still awaited, along with the accompanying Approved Code of Practice. However it is likely that the new regulations will be based on the following:


  • All construction activity will be subject to the CDM regulations irrespective of the amount of time the work will take or how many men are involved. This differs significantly from the current legislation which applies to work involving more than 4 men on site or work lasting >/= 30 days on site or >/= 500 man days in total.
  • The Client will have specific responsibility for ensuring that sufficient management of health and safety is in place for all construction work. This means some CDM duties will also apply to routine maintenance activities.
  • CDM Regulations and the Construction (Health, Safety and Welfare) Regulations will be combined into one.
  • Construction projects will either be non-notifiable or notifiable. A notifiable project will use the same criteria as present, i.e. work lasting on site for >/= 30 days or >/= 500 man days is notified to the HSE on form F10.
  • The Client will be responsible for notifying the HSE (F10) before design or planning starts.
  • The role of Planning Supervisor will be replaced with a new duty holder - the Coordinator.
  • The Client must appoint the Coordinator but only for notifiable projects. Similarly, the Client must appoint a Principal Contractor for notifiable projects only.
  • This means the 4 man rule and demolition rule is abolished.
